USAGE OF PHOTOS

We will never use your photos with your name or any other personal data with the exception of a school name. We however own the photos so we assume that we can use your photos for advertising purposes. We will follow the school's "DO NOT PHOTOGRAPH" list for not sharing those students' photos. There is a good chance that after the ordering period for your event, your photos will no longer be available to you if you are on the school's do not photograph list.

PRINT RELEASE

A print release is for further printing of digital files purchased. Anthony R. James, Photographer cannot guarantee the image quality of prints and products printed through third-party vendors via the client's print release. A print release is only for the individual who purchases the digitals. With the purchase of digitals, the purchaser is able to print as many copies as desired and use the photo to make other photographic products. The print release is for personal use only and not for commercial use. It is not to share the digital images with any other party, as this is a violation of the terms of the print release. Print releases are not the same as releasing the copyright. The copyright of the image, unless otherwise stated specifically here, resides with Anthony R. James, Photographer.

Materials protected by this copyright include any and all images any and all text; (including logos and other graphics); and any and all design elements of the website. You may use the content of anthonyrjames.com for shopping, placing an order on this site, or for conducting other tasks associated directly with, and for the sole purpose of, shopping on this site or placing an order on this site.

Unauthorized use of the materials appearing on anthonyrjames.com may violate copyright, trademark, and other applicable laws and could result in criminal or civil penalties. Such unauthorized use includes, but is not exclusive to, copying, reproducing, republishing, modifying, uploading, transmitting, or distributing any of such materials without the prior written consent of Anthony R. DISCLAIMER AND LIMITATION OF LIABILITY

Unless otherwise noted, because of the custom nature of the transaction, and the prevalence of illegal reproduction facilities, products sold by Anthony R. James, Photographer are non-refundable. Replacement items for damage in shipping or misidentified images will be honored within a 7-day return policy. Anthony R. James, Photographer makes no representations or warranties, either express or implied, of any kind with respect to products sold on this site. It is your responsibility as the buyer to download your photos in the time period that is allowed and make back-ups of your photos. After your event ordering period, a new link for your downloads may not be possible.

RETURN POLICY

Unless otherwise noted, because of the custom nature of the transaction, and the prevalence of illegal reproduction facilities, products sold by Anthony R. James, Photographer are non-refundable. The files that appear are fully edited images. The RAW files are not for sale and any notes to our studio about editing may not be possible. By purchasing you are agreeing to the files that you see in your album to the way they are edited. When you place your order you are approving your prints and products to be cropped the way that they are displayed on the screen. They can be cropped to your preference while ordering, but after placing an order, there may be no guarantee that changes to cropping can be made.

Replacement items for damage in shipping or misidentified images will be honored within a 7-day return for the replacement period unless otherwise noted. All returns for replacement must follow the conditions below:

• Anthony R. James, Photographer will not accept items that have been intentionally damaged.
• All products must be returned complete.
• All returns must be shipped freight prepaid.
• All related fees (shipping & return shipping fees) are non-refundable for all products.
• Please allow 2-3 weeks for all replacement orders.
• Claim for missing products must be reported within 10 days from the date item is shipped.

Anthony R. James, Photographer does not rent, trade, loan, or sell your personal information or any other information which may identify you, to third parties. We are committed to protecting my customers' privacy. The information I collect is used to process your order and to enhance your shopping experience.

ORDER ACCEPTANCE POLICY

Your submission of an order and/or receipt of an order confirmation automated or otherwise does not signify my acceptance of such an order. Anthony R. James, Photographer reserves the right to cancel any order that I deem necessary, at my sole discretion, regardless of the order status or whether you have received a confirmation of the order. We reserve the right to require additional information from you before accepting or processing any order.

TYPOGRAPHICAL AND PHOTOGRAPHICAL ERRORS

Anthony R. James, Photographer attempts to be as accurate as possible in pricing, as well as his typographical and photographical depictions of products for sale; however, he cannot guarantee that product descriptions/specifications, pricing, or any other content on anthonyrjames.com is accurate, complete, or current. If a product is listed at an incorrect price due to informational, typographical, technical, or other error, Anthony R. James, Photographer shall have the right, at his sole discretion, to either honor the displayed price or refuse/cancel any orders placed for that product at the incorrect price. Anthony R. James, Photographer has the right to make artistic cropping to the final printed product to the best of his ability and discretion.

UNAUTHORIZED RETURNS

Shipments that are refused without authorization, or that are returned to us because the address was invalid, are subject to a fee of 15% plus applicable shipping and handling fees.

JURISDICTION

Anthony R. James, Photographer is a sole proprietorship with its principal place of business in St. Johns County, Florida and you agree that any legal action brought against Anthony R. James, Photographer shall be governed by the laws of the state of Florida without regard to its conflict of law principles. Additionally, you agree that any and all disagreements arising from your use of or orders placed through anthonyrjames.com will be adjudicated in the county of St. Johns County, Florida by an appropriate federal or state court.
